Jothy’s Fish Head Curry Banana Leaf Restaurant

a.k.a. The Worst Fish Head Curry and Banana Leaf Restaurant in the Known Universe

jothys fish head curry banana leaf rice

Jothy’s Fish Head Curry Banana Leaf Restaurant is located in Api Api Center in KK, Sabah and has a lot of impressive stickers on its front window facade, including one that says “as seen in Lonely Planet”, which was the reason we headed there to eat in the first place. I place a certain amount of trust in the Lonely Planet brand.

jothys interior

The first clue that it might not exactly be the best place to eat when we walked in is the underwhelming crowd in the restaurant. We were the only ones there. I swear I could hear crickets chirping.

jothys banana leaf

Their banana leaf rice seems authentic enough…

jothys banana leaf rice

…but the taste did not live up to expectations. I tried every single one of the side serves and found them severely wanting.

jothys curry fish head

Their flagship signature dish – the curry fish head – was tough, overcooked and dry. It’s certainly not “the freshest fish head from the market”.

jothys curry fish head meat

I don’t know what kind of fish this head came from but finding meat is like looking for a needle in a haystack (or insert other cliched analogy here since there are a lot of fish bones in there).

jothys prawn

The fried prawns were not “succulent” as the menu claimed, but tough. I’m also highly doubtful about the “choice fish eggs fried to perfection” description as our fish roe had the same taste and texture of cardboard (not that I’ve ever eaten cardboard – it’s what I imagine cardboard would taste like).

jothys lonely planet

I find this unforgivable in a place known for it’s abundance of seafood. The bill was exorbitant too – the fish head curry alone was RM 50.

jothys herpes

It’s a tourist trap. Avoid it like a bad case of herpes.

  2. WEEN: It’s in the middle of KK city, gotta be a tourist trap. Crap.
Yeah, we ate everything. I couldn’t finish it though.
    Verdict: Bad.
    Just being honest here. πŸ™‚
chrisblitz: HAHA! Very apt analogy! I take my hat off. πŸ™‚
Yeah, but surprisingly, it was recommended by Lonely Planet, which I tend to trust, kinda, sorta.
It’s not even budget! The meal was damn expensive. πŸ™

Just like Sibu, we have hidden gems like Monkey kampua which non-locals would never think of going in. πŸ™‚
Erica: Oh, we have great banana leaf in KL. Just not in KK. πŸ™‚
This was extremally disappointing coz they didn’t set the right expectations. πŸ™‚

Thanks for the tip about Krishna! πŸ™‚

Anyway, what’s with the fish head, did you complain to the restaurant? Eh abang, cannot find ikan lah, lu mao cari. susah cari leh, macam cari g-spot lah. ha ha
Running a business is actually not difficult but takes a lot of discipline. that’s where most people fails. They makes 5,000 a month and spends 7,000. Not that the business is bad, they just can’t handle the cashflow.

rocket: Nope, my studio unit is pre-furnished, it’s a serviced apartment so it can’t fit a washing machine. It’s only 500 sq feet.
It was the VERY LAST curry fish head actually. I don’t know how many they actually cook. πŸ™‚

Jothy’s used to be good and packed in years past! The wife is the Chef! The guy in green in 2nd pix is the husband aka owner.
My last meal there was 4 years ago when I got a diarrhoea after having their side vegs. Turned out one of the vegs was already stale!
Krishna’s would be your best bet for a decent fish head curry in KK. Located at Millennium Plaza. Usually packed too and the owner is a KLian married to a local. The owner is funny too when he announced to all diners, “I have to go home now because my wife asks me to wash and hang all the dirty clothes!” …lmao!

  21. freedom of speech is cool but there is a difference between ethical blogger and online cool wannabes. i don’t see how could someone relate food experience with ‘herpes’. come on, thats very unintellectual and immature.

i hope we all learn from this – myself included – and start blogging with ethics. so its not up expectation? write that the food is not up to your expectation. be rational and fair. u can be cool and win fans in so many ways other than sounding like a total ass.

From what I’ve read, it’s a fair and substantiated review. Suing you (and Google) seems like a pathetic attempt to extort money and is totally ridiculous.
As if, food commentators don’t have the right to give bad reviews! PLease! Get with the programme, Jothy’s, and improve where there is room for it.

As for the haters, like annie (above) … you need to learn to read. At no point was the dining experience equated with herpes. The comparison drawn was been avoiding the restaurant like one would avoid herpes. An amusing simile, I thought. Writer’s styles vary and humor is not everyone’s cup of tea, so if you don’t like the writing style, simply don’t read the blog annie!

Service was horrible and the food was hopeless.I did’nt even finish my food. Really regretted not eating in McDonald’s next door.
The only consolation was the Mango Lassi which was above average I’d say.
Was wondering how in the world could this place get recommended by Lonely Planet but then I just left it at that and flew back home to KL. Just read about the lawsuit today and I believe that the comments in your blog was justified. They DO serve lousy food with a pathetic excuse as a banana leaf restaurant.

when someone says your food sucks, u sue.

dear mr. tharumaraj, to avoid such complication in the future, it is avisable to put up a warning sign in front of your restaurant, just next to the Lonely Planet stickers, that sounds something like this:

WARNING! Only praises on our food are allowed! Those who criticize on our food shall be prosecuted!
(*with a fine print: minimun RM6mil punitive damage shall be seek)

    Reply
  27. Totally agree with your review. Quality of the food is below average. Doesn’t justify the price they charge for it either. IMO the owner is just looking for an excuse to why people aren’t coming to his restaurant anymore. Having someone to blame is easier than admitting that your food sucks.

  28. Read in TheStar about the law suit and went searching on the net.

Found reports and photos on tripadvisor. Shook my head when reading about the food prizes and saw the pictures and put that in comparison with a RM 6million lawsuit.

Then, after reading this blog and seeing more photos of the eatery, I get the impression that Jothy’s owner PLUS his lawyers are total fools. The looks of the eatery are not even middle-class (compared to restaurants I have eaten in in Malaysia), but they sue for world-class damages. Not even the poshest restaurant on the planet would sue for RM 6million/USDollar 2million in revenge for a client’s complaint.

If Malaysian judges have any proper senses they should throw out the suit and slap huge fees on Jothy’s owner and his lawyers. What a greedy lot.

  29. Eating at that place (I can’t mention the name or I get sued) is just like an astronaut who have landed in a Lonely Planet indeed. Imagine at the first instance of arrival you’ll find the funny stare that will come from the eagerly waiting inhabitants. To your surprise, you are indeed alone in a place that was supposed to be in abundance of food as endorsed in a famous travel magazine. Expecting fresh cooked food is definitely impossible because you’re the first visitor from a million light years planet called “Earth” after the last alien visitor who died of food poisoning a hundred years ago. After you’ve eaten the food that probably was frozen for a long time, the meat surely will be tough and the taste is like a frozen meat unfrozen and frozen so many times that you can taste the calendar in your tongue. The cashier shivering with excitement, preparing to punch in the exorbitant amount on its keys, as time change and maintenance cost are high while waiting for the next customer which is another light years away, the value that you eat is definitely will be costlier. Well my dear planet travelers, before you follow the guide magazine, look when it was publish or you end up traveling so many light years away and when you write a complain and commented as an unsatisfied customer that paid the exorbitant bill, you get sued exorbitantly too…just for a frozen dunno what fish head. πŸ˜€

    • …ha ha, who’s scared with Indians? (although not all Indians are kinda bad or boastful) that’s why you only find few Indians settling in a land that chop anyone’s head off (Sabah & Sarawak) if they try to be funny but I guess this restaurant is chopping a lot more than that when its suppose to apologies to an unsatisfied customer and improve whatever is lacking on their restaurant in order to be accepted in a very competitive environment of food and beverage services. I’m an avid Indian food lover and I’ve known many Indian restaurant operators that can accept constructive criticism, I guess this operator is not even closer to those Indian restaurant operators I’ve known so messing with us (Customers) till their last breath will only make themselves a fool…boastful too and end up a loser.

Not sure how the Malaysian courts will react. Considering that our government seems to be going on an anti-blogger crusade these days, they might decide to make an example out of you – even if your blog is not political in nature.

  40. appreciate your honest post but honesty have different level, and not all people can accept brutally honest comments like yours, malaysia restaurant is not like overseas restaurant whereby you can just go to any random rest with no expectations and still endup getting good service and food, here even if the rest have good review you still have to depend on luck, sometimes it’s not good today but if you go again you’ll receivd different result, it depends, i’m not saying that this post is your bad luck day maybe this rest is really bad.

but the line “It’s a tourist trap. Avoid it like a bad case of herpes” is too much to accept by anyone, imagine if you’re in the owners shoe, its really a business killer lines esp when your blog is ends ups a popular blog post. this teaches bloggers to use their word carefully when reviewing rest/etc, professionalism in writing needs to be taken seriously, e.g kyspeaks.com he’s one of the professional food blogger around. good luck.

I ALWAYS complain about East-Malaysians cooking crap.

And I always say “avoid it if you donΒ΄t want to know what shit tastes like.”

      Reply
      • Are you sure about this? How many “East-Malaysians” dishes and places have tried to make you come up with this kind of statement???

        Reply
        • I am a food lover. I have travelled and indulged in food from Padang Besar to Kuching. And I donΒ΄t go to tourist spots for food.

As with most places, from tomyam in Perlis to laksa Sarawak in Sarawak, only a few are good at what they do. But the problem is more obvious in East-Malaysia than in West-Malaysia.

Apart from the occasional specialty, there is nothing — I repeat, NOTHING — that is even worth spending expensive money on.

DonΒ΄t be sensitive. It is a fact. East-Malaysian food generally doesnΒ΄t come close to West-Malaysian food even in the same class, e.g. roti chanai vs. roti chanai. The reason is because East-Malaysian food (and methods of preparation) has not undergone the fusion and integration that you find in West-Malaysia. This is one of the Malayan strengths, i.e. diversity.

[The irony of this all is that West-Malaysian societies are becoming more disintegrated — hence the racial polarisation.]

And how many East-Malaysian dishes and places have you tried to dare to challenge me?

[Note: Please spare me the list of details. Just generally will do.]

  41. Hi there. What you are doing is called FREEDOM OF SPEECH and an honest comment for the judgement of the public. I thank you for your honest information.

I am very much against the abuse of the defamation law to conceal the truth. Therefore I have just set up a weblog http://malaysiadefamation.blogspot.com/ to create awareness, highlight those defamation cases in Malaysia which should never be dragged to court, moreover to teach you how to fight for your rights in court. My blog is still new, but hopefully within time it will assist someone out there.

I suppose it’s high time that organisations should not be allowed to sue for defamation especially those organisations who produce and sell food and consumer goods. I believe customers have the right to openly critic and organisations have the right to challenge, dispute or explain to their customers but not to the lengthen of suing them.

I believe Malaysians are not foolish to judge what is false or true. The only way to fight against organisation defamation is to remind them about consumers’ rights and to show them that they have forgotten that their customers is the boss and has the power, not the courts.

  42. Come on guy, that not the way to tarnish other business, if you think that jothy restaurant is that bad why totally kill his business, let other judge it instead of you, might as well shut up and mind you own business rather than commented roughly, so you are suck than.

    Reply
    • Let other judge? Who is that other?? We the CUSTOMERS, who is paying money for the food and service are the one and have the right to judge it!!!

I am totally upset and frustrated with private shops/company running their business knowadays. It seems like they don’t bother about making money out of your pocket at all (of course a lot of them are just employee and not the boss itself, but you do come across some who are the bosses themselves). I went to government department and found out that even government servants are having smiling face which I can’t find on those private one!!

      Reply
    • Shut up and let others judge? Not much for freedom of speech, are you? What about the others judging? If they don’t like the food also, they should shut up as well? Going by your logic, I don’t like your opinion so maybe you should shut up and not post it. What a wonderful world this would be, eh?

I find the accusation of “killing his business” to be hilarious. If all it takes to bring down a restaurant is ONE negative review on a blog, than there’s something fundamentally wrong with your business in the first place. The occasional negative review is part and parcel of the food industry. Good restaurants are able to weather them. Bad ones pin the blame on critics instead of examining their own faults.

Similarly, where was your common sense when you wrote this article?
One look at the food, you should know you eat the banana leaf.
Who ask you to eat anything else?

    Reply
  44. Dear commonsense,

If you had any common sense in the first place, you would have been able to see that the restaurant is not doing well in the first place. The owner obviously don’t bother with customer feedback or even customer service which is why the food sucked in the first place, and therefore ex-customers avoid it like a plague. This lawsuit will just make more citizens feel repulsive about his shop and detest to step in there. Also, even the price is way exorbitant. I’d say the blogger saved the tourists from a trip to an unpleasant restaurant.

I for one WILL NOT visit that shop. If you can’t take the feedback, don’t open the shop. This is a service industry. My thoughts is that the owner just want to make some money, close the shop and start another one somewhere serving distasteful food. How unprofessional.

  45. hehe….uncommonsense

When someone says something obviously wildly exaggerated as a figure of speech, only idiot will use it as basis to sue. That’s what common sense is about.

I did sound like whacking Huai Bin. Read carefully again between the lines.
Does the food look appetizing to you? Only the banana leaf looked the best.

“the worst restaurant in the universe” & ” avoid it like a bad case of herpes” was totally uncalled for! If you had a problem with the food & it wasn’t up to your standards/expectations, then you should have wrote just that.
What happened to ethical blogging/writing? Have you even thought about the years of hard work & money these people would have put in? Its so easy for us to sit around and condemn others but put yourself in their shoes, how would you feel/react if someone said nasty things to tarnish your reputation? Don’t forget, you’ve had an interesting past and you are no angel yourself.

    Time to reflect Huai Bin!

    • i am a restaurant owner and blogger myself in kl, every morning i went to market and deal with fresh supplies. i often flew around malaysia as well to eat n share my experience online. i came to find that fishes in sabah are not cheap. i did try out at jothy’s last year and i think the food is not as bad as claimed, the price might be expensive for certain people but i think it is reasonable for the market over the east.as a restaurant owner i always read through everything in the menu before i order, as i remembered, the fish head price was based on the size of the head; and the menu stated clearly that the price is to refer to the waiter..i guess hb did not aware of that. i did not order the fish head due to the size, so i ordered curry fish instead. my point is there is such thing as west and east prices, if u are familiar in this area of business u would have known.

      • And if you are truly a restaurant owner and food lover as you claim you are, then youΒ΄d noticed in the photos supplied by the blogger that the fish head curry dish is either not fresh, overcooked, badly prepared, a leftover, or all that has been mentioned.

And if youΒ΄ll also make an effort to take a closer look, the guy who was serving at the table was not wearing proper hygienic attire. Since you are a restaurant owner, I donΒ΄t have to tell you what attire should be worn, and which laws are being broken.

What happens to consumer right to be served and get what they paid for? There are way too many self deceived people who think they can get into food business without even have the right skills and tools. is it wrong for huai bin, as a consumer to voice out his opinion that he paid so much for crap? In this bolehland, semua org kata apa apa pun boleh but Ade quality ke? Malaysians just wake up from your freaking slumber and demand for your rights. If a waiter serves you poorly, demand for a better service. If a product claims to certain benefits and purpose and doesn’t function that way, ask for a refund! If you are served crappy food, voice out.

If Malaysians decide to be complacent and adopt such tidak apa attitude then in the new few years, I can assure you that this country will soon face a major problem. Large poverty gap, racial inequality, bad education system, high medical care, etc.

  54. I agree that suing somebody just because of an unfavorable comments against them is not right.

But i believe that making a comment against someone should be fair too.

More ever, food tasting is very subjective. Each of us has our own taste.

I have been to a fish curry head shop in KL (a very famous and appeared in the newspaper too). For me it is very expensive too, RM60 for half of the fish head). The meat is hard, as a person who loves cooking, i know it is over cooked. I have been to other banana leaf fish curry head in various part of KK and sabah. For me all taste the same, nothing special. I think the fish head is better if it is boiled with ham choy, sour plum, tomato and tau foo.

So, there you are! Some might have tasted the food in Jothy and they like it but not you. Very subjective tasty issue.

By threatening to sue Mr Poh and Google, and thus bringing it to the attention of the international community, only serves to highlight the negative review – which would have probably have been missed or ignored by readers, as they would weigh the number of positive reviews against the number of negative reviews, to form their own opinion.

We all have have choices to choose from but we will listen and consider the opinion of others such as mr huai bin here before making our decision.

I hope other businessmen/women out there to value and listen to their customers and their feedback to provide a better service to them which in turn will make their business prosper even better more than before.

Generally, as Malaysians we all enjoy eating and have acquired a high expectation where food is concerned. Hence, I would feel very cheated & upset if the place was generally well known to serve good food and it proved to be such a let down. And worse if I had to pay a slightly above average price for it.

To the restaurant operators, we are not saying you have to serve food of excellent standards, but if your food is only average and there is no extra effort given to provide customers a satisfying culinary experience, you should not advertise it as such.

When commenting/reviewing, bloggers/writers should give constructive comments, come on dude everyone knows this. I’m not saying you should sugarcoat things but just be fair in the comments that you make.

And how do you justify freshness/authentic-ness from just looking at photos? (this is referring to David’s & commonsense’s response above) Any professional food photographer will tell you how difficult it is to take good pictures of curries. And what looks good on photos may not necessarily taste good and vice versa.

It looks like Mr. Tharu, you have got to un-sux it. Improve it, Make it good so the whole world can make it a beeline outside your shop to eat it.
People will take the trouble to spend time lining up in queue to eat a good food. Period. Please do not behave like a spoilt brat by whining like a stuck pig to tell the world that you are going to sue this or sue that. That is just so typical.
I also bitch about food joints. I wrote a blog about an ‘unhygienic’ bug that was found on a curry fish head dish my family had here in Shah Alam, near Klang. So who can sue who?

  65. Mr Tharu or mr Jothy or whoever this restaurant belongs to can sue Huai Bin a million times or as how many times he likes but Huai Bin is not at fault as there is no gazetted outline on what words cannot be used while blogging.

On the otherside, Huai Bin, you must take full responsibility of what you have written. People may start to like or or hate you otherwise. Its nice when people support and like what you have done but then, there are another half you hates you for what you have done. When hatred, anger or ill-feelings arise, he or she may be tempted to commit the unthinkable. The world is not a safe place anymore. People get mugged even in broad daylight.

My point is, each time we thought of achieving something, there is always 2 options to choose from, the good way or the bad way. Good way mostly will benefit us in the end and bad way will always have a bad ending.

My 2 cents for Huai Bin; In any argument or conflict, there will be 2 sides, the good person and the better person. Since I’m supporting your case, I suggest that you be the better person., and you’ll know what to do next.

First of all, congrats to restaurant owner for the bald move. someone needs to get these bloggers once and for all because they are getting more and more big headed every day. teach them a lesson to be more responsible with their words and writings. these are the kids that grew up with gold spoon fed into their mouth and i swear i’ll never let any of my kids to be so disrespectful and stupid. too much crack i suppose.

I personally think the blogger thinks he is a movie star in his own world and he thinks he is above the law. and i suspect he was high on crack as he writes this. and the funnier thing is people seems to support this drug addict. other than ruining people’s reputation for the sake of fun, i wonder how many other innocent soul he has sold drugs to?

secondly, in non personal but rational opinion, if i am to support this kind of uncivilized action, there is no way this blogger can win in court. of course he can win if

    (a) he bribes the judge
    (b) he can prove the restaurant’s fish head curry is the worst in the whole universe
    (c) he justify how the restaurant can be related with herpes

so moral of the story is you can win readers in soooo many creative ways without sounding like a total ass. choose your words carefully and if you are afraid it might not sound interesting, try to read more and expand your vocabs.

and to those bloggers who feels this asshole, remember, it is so easy to go against something but it takes mental capacity to discern from right and wrong. be smart with your judgement. most of you live by ‘monkey see, monkey do’

and remember, im having my freedom of speech. don’t spit and lick it back. shame on you people

After reading and going thru PHB’s blog, I personally think dat PHB should learn a lesson from dis. Dat goes to all bloggers as well. Imagine running a business and A NOBODY (actually a drug addict and a pest to the society, a disgrace to his own family hahahahaha) starts talking shit bout your business when there are millions of ways u cld say ur not happy about a restaurant. i mean who the fuck is he anyway?

PHB i suggest u apologize to Jothy’s and who ever u talked rubbish about in the past. If u think your still rite well i guess its up to the court to decide…… dis wld be an exciting news…… Bloggers, learn sumthing from PHB’s case…… try to be fair and ethical wen doing reviews, people including the owners of the restaurant wld appreciate it. It wld give them room to improve in fact, they might call u up to do a 2nd review for free….. But by saying shit about d restaurant, it wld only create enemies and a lawsuit filled against you…… so learn sumthing out of this PHB.

Big talker now. Too arrogant to rectify with Mr Jothy. You deserve what you asked for.

    • Customers Rights depends on situation and in this situation HB used it wrongly.
when you want to criticize people’s restaurant it must be in a smart way not the way HB did. It just shows the moral value in you people the supporters and HB him self that you all really don’t know how to value anything at all. I support Jothy’s restaurant cause each and everything that HB said was a LIE in his pic he said “Their flagship signature dish – the curry fish head – was tough, overcooked and dry. It’s certainly not β€œthe freshest fish head from the market”. i ate the fish and it taste fresh plus the flesh was not hard or tough like what HB said. And to HBSupporter when you said “Yes, u’re RIGHT! You have a fundamental right to sue people as you a very BIG LOSER who afraid to accept failure” i think you must be really dumb cause why would anyone want to fail in business?? unless the person is you right..if this happened to you i bet you would be all out trying to save your ass right??

  73. I agree with all that says food in Jothy’s is good, i am in Kota Kinabalu for a holiday and arrived here 2 days before this news was out.
All that i can say is the food is good and the owners of the shop are friendly. i have traveled a lot and and have faced real bad food but this restaurant is no where close to bad. The picture is clear and i think that the admin of this blog is nonsense.
relating food to herpes i think you were high or something cause that is the first time i ever heard anyone said things like that.
and last to the admin use your brains next time you want to do things like this my advice you start eating at home cause lots of restaurants would not welcome you.

pardon me but i believe you are missing the real point here.. please bear in mind mr. jothys didn’t sue mr. poh just for the bad review alone and this is not a casual post as you claimed. the allegation made is very serious.

im both a blogger and a business owner myself. we business owners appreciate constructive reviews and feedbacks regardless it is good or bad. but to have someone criticize your service in the most irrelevant way sure is not a brilliant thing to do.

im not a fan of spicy indian food so ive never been there. and honestly i dont care if the food tastes good or bad coz thats not the issue here. i just dont agree with the blogger for using unsuitable terms such as ‘the worst in the whole universe’ and ‘avoid it like a bad case of herpes’.

  78. wow this is huge. both parties have good arguments here. but after discussing with my fellow colleagues, we all decided the blogger is at fault for provoking controversy by making two major statements

    1. a.k.a. The Worst Fish Head Curry and Banana Leaf Restaurant in the Known Universe
    2. It’s a tourist trap. Avoid it like a bad case of herpes.

    these statements are downright ‘defaming’.

i dont understand why people question the restaurant owner for suing the blogger when the blogger is the who should be questioned for his brutal and harsh words.

as how i see things, the restaurant owner wasn’t suing a blogger for his bad review. he sued him for his defaming statements. that’s about it.

pity the blogger tho, it seems like everyone is highlighting his ‘side activities’. he was wrong for his harsh statements but it has nothing to do with that.

maybe the blogger should call a truce and make a public apology. i believe the restaurant owner is just fighting for his rights.

thats all, dont be mad at me. peace all ^__^

Anyway, sense of humor is different for everyone but to address it:

      1. a.k.a. The Worst Fish Head Curry and Banana Leaf Restaurant in the Known Universe

This is actually a Douglas Adam’s reference. πŸ™‚

      2. It’s a tourist trap. Avoid it like a bad case of herpes.

The term “tourist trap” according to Wikipedia:

A tourist trap is an establishment, or group of establishments, that has been created with the aim of attracting tourists and their money.

This has been confirmed by Jothy’s in The Star article – they have mentioned that tourists form a large part of their customers.

The herpes comment is a simile – it was my opinion that there are better choices out there.

Thanks again for the level-headedness and intelligent commentary April! πŸ™‚

  80. it is true that the writer has use some excessive offending word that by nature exaggerate and not polite. to be fair, lots of people are doing that unconsciously especially the comedian performer. i saw lots of defaming comment that was written in this post about HB that gives the him the locus standi to file a legal suit over some of them. if that so, our court going to be so busy with defamation suit by everyone, anytime, anywhere.

let think about it, can i take legal action over someone if i am not happy about some services? or anyone that said, my english was so bad even a blind don’t want to read it. it is defaming by its own rights. can i sue the teacher of saying my children are stupid when he failed to read the specific paragraph? or can the Prime Minister take legal action on its citizen because he criticized his leadership in facebook or other blogs or comment? if yes, i believe we’re so in deep trouble now.

to be fair the restaurant have all the legal rights to take legal action on him but all of this will not going nowhere. we should look at things in a bigger picture. by right, i believe consumer deserved the rights to criticized and scrutinize in any form over the things that he paid for the expected services but for return, the alleged deserved the rights to scrutinize the critics in any form.

the different in this point is how we react on this issue. we can save lots of troubles by changing the way the business run. instead of focusing on these insults, proof to all the people that you’re the real thing. find out what is so wrong with your food by contact the blogger and i believe he will willingly tell u what he find wrong and if its help, he can help back by apologizing and maybe do promotion back to the restaurant.

i always believe, win by action and not argument. a good business person will not put himself or his business at bad headlines. taking legal action over a bad food review only give bad publicity to the restaurant and fame to the blogger as he become again the headline. thanks to the effort by the restaurant owner. the loser is the consumer like you and me.

i hope that the owner think twice before taking any action that not benefits the consumer. it is an overkill like using a canon to hunt a deer. like it or not, i cannot accept this is an anti-consumer and anti-free speech legal action to where facebook, blog and internet now are essential to the freedom, liberty and justice in our society in this nation. to do this carelessly, we will dragging us back to medieval ages where anarchic and fascism will our future life.

it can be settle in a better way win win situation.

indeed this will be a landmark case if it success to get the 6 million damages ruling. in future this case will be a reference to all defamation suit where there will some people abuse it for its own agenda. in future we will not able to speak freely even at internet without worries of lawyers taking legal action everyday, anywhere, anyone.

  81. You are really stupid for thinking that “talking” will resolve the problem. Let me tell you (since I have tried many times), talking to drug addicts is similar as talking to a wall.

Poh Huai Bin (a.k.a. PHB or “druggie”) committed defamation. This is an important legal term.

If he commented, “I didn’t like the food and I think it isn’t worth my money!” This is a subjective statement and can be considered an honest opinion. Therefore, the defendant is a sound legal defense in libel cases.

If he commented, “The restaurant claims to be halal but it serves pork!” This statement is pertaining a material fact, which can be proven true or untrue. If untrue, the plaintiff has a legal standing in the civil suit.

So what did PHB do? He related the restaurant with an STD. Any half-qualified lawyer will tell you that he has gotten himself in deep shit. Real deep shit. Serves him right!

    • Well said, Lindsay. An emotional security blanket is what Mr Blogger needs now. Or maybe drugs. Who knows.

Nobody is perfect. What separates maturity and immaturity is that the former will face the music; the latter will play blame games by diverting attention from his/her own actions.

  86. The way I see things, Jothy’s has noticed a decline in diners, in particular its ‘international’ customers and decides to investigate. Although ignored at first, HB’s Internet post and Google will later become targets. HB’s post was the first on Google search results when I typed in Jothy’s Fish Head Curry the other day – and this is why Google is entangled in this lawsuit as well. Yes, Google. The company with deep deep pockets. But you need to consider other factors folks. A good one is competition. Alot of KKlites nowadays will say that Krishna’s is their favourite Indian (and locals or taxis tend to recommend them to tourist and so forth right?). Also, do most tourist judge a food joint based on some random ‘blog’ post or the popular Tripadvisor.com? (tripadvisor, btw, has above averages raving reviews for Jothy’s).

After reading HB’s post one would immediately request HB to apologise for the language used, but hey, at the end of the day, its just a blog. Its not even a regular food review blog. Its just a blog about personal opinions and about how HB carries out his ‘alternative lifestyle’. We also come to know that this guy can be slightly *cough* crazy and his writing can sometimes be ‘colourful’. So, should we take this food review post seriously? And who is more influencial here? HB, Lonely Planet or Tripadvisor? Nonetheless, I foresee a formal apology and some sort of out of court settlement in this case.

  88. KUCHING: An engineer of a private firm was fined RM 2,500, in default, two months jail by a magistrate’s court here yesterday after he pleaded guilty to possessing cannabis.

Magistrate Tengku Sharizam Tuan Lah imposed the sentence against Poh Huai Bin, 24, from Sibu after he pleaded guilty to a charge framed under Section 6 of the Dangerous Drugs Act, 1952.

Poh admitted to possessing 2.85 grammes of cannabis at 2:30 pm in a room of an apartment at Chong Lin Park near Jalan Tabuan on November 21st, last year.

According to the facts of the case, a police party led by Inspector Kumaran a/l Sanmugam arrested the accused in his office near Jalan Rock for alleged involvement in drug activities.

The accused later brought the police to his apartment at Chong Lin Park where he showed them a cigarette packet containing dry leaves. The police seized the packet and immediately arrested him.

In mitigation, Poh pleaded with the court for a lenient sentence saying that he was the sole breadwinner of his family and promised to turn over a new leaf.

    Poh paid the fine.

  89. KOTA KINABALU: The director of a fish head curry restaurant which is recommended by Lonely Planet is suing a blogger and Google for defamation.

The suit filed on Monday is over allegedly defamatory statements made about Jothys Fish Head Curry Restaurant here which was posted in May last year by Poh, who is originally from Sibu, Sarawak and now resides in Kuala Lumpur.

Tharumaraj said he felt very let down when the blogger demeaned his fish head curry and banana leaf restaurant and urged the people to β€œavoid it like a bad case of herpes”.

β€œThere were many people who posted positive things about my restaurant in his blog but it was removed and only the negative chats were kept,’’ he said, adding that he did not know the blogger.

As a result of the defendants’ action, Tharumaraj claimed he suffered losses and damages and his restaurant’s reputation had been affected, both locally and internationally.

    1. wanting to kill yourself (can happen to almost anyone)
    2. trying to kill yourself (if you succeed, then much respect –you’re a success)
    3. trying poorly to kill yourself
    4. making goodbye calls or writing notes prior to trying poorly to kill yourself
    5. failing in an attempt to kill yourself
    6. telling anyone who doesn’t have to know about it that you tried poorly to kill yourself and failed
    7. posting about trying poorly to kill yourself and failing on your public blog

I have enjoyed your blog until now. Now I know that you are a sad attention-seeker. What you did is the sort of thing we expect from some spoiled, rich 16 year old girl here in the USA. It’s a terrible disgrace for a man to behave like this. It’s the opposite of going out like James Dean –which is actually pretty stupid too.

I don’t know how long you have been using drugs at a serious level. What I see is someone who may have stunted his psycho-social development at the teenage years.

Kill the blog. Get off the stage. Get some help now. Life is not like a movie. Behave like an adult. In the event you try this shit again, go vertically on the wrists. A warm bath will help stop coagulation. And don’t do it in a hospital. Killing yourself is so damn easy –how could you screw it up?

  96. Hey dude, Judd here from the Philippines. We’ve met at the AP blog awards a couple of years ago, but you probably don’t remember me.

As a fellow food/travel blogger (I write at serialtripper.com), let me put in my two cents in your case against this restaurant. First off, I support you. There’s no fcking way a restaurant should sue a blogger for writing his personal opinion on whatever sht (pun intended); such is the nature of user-generated content and blogging. You can write whatever you want, after all there’s a supposed freedom of speech on the internet. That’s the natural course of personal content, because in the end, the truth eventually wins.

If you wrote truthfully, then there’s even less reason for the restaurant should sue you. If you wrote falsely, then you – as the blogger – will take the fall along with the restaurant (who should, in the grand scheme of things, recover as soon as the public realizes that their food isn’t as bad as you say). In a nutshell, it’s also your reputation on the line – you don’t just talk sht unless you’re asking for it, too.

Also, let me ask all blog readers and restaurants now: how will a blogger be believable if all he talks about are positive reviews? Along the line, a blogger is bound to experience negative things (ie. bad food, the kind that makes you want to avoid the restaurant like herpes), and he should feel free to write about it as much as he writes about the good stuff.

Goodluck to you and your blog.

    Reply
  97. i believe PHB is entitled to his opinion. does Jothy’s owner expect to have good review on his restaurant all the time? if a blogger only writes good things, i doubt i will want to read his blog a 2nd time.. that is why i appreciate websites like trip advisor.. where people give good and bad comments.. and then I will gauge for myself whether i should visit this restaurant/hotel etc..

As a “service” provider, Jothy should accept this feedback positively and focus to improve on the quality of food and service instead of getting on the defensive.

This is a case of service provider vs consumer. In my humble opinion, this seems like a case of intimidation so that consumer will kow tow to service provider. For PHB, I support you.. your reputation is at stake. Someone quoted, “It’s better to die on the feet than to live on your knees”.

CUT both your hands… or better still your legs… OR HEAD! OR STAB YOUR HEART! JUST DIE ALREADY!’ please. Really quite ironic to see people trying to diss people for posting rubbish BY posting rubbish.
‘The Worst Fish Head Curry and Banana Leaf Restaurant in the Known Universe’ and ‘Avoid it like a bad case of herpes.’ sounds like an attempt at being funny but came off as immature.
As far as I’m concerned Jothy can serve the worst fish head curry in the entire universe as much as he wants and mr admin can be as emotional as he wants about it ~ why all the vultures here looking for drama?
And frankly, I would not eat a very bad curry fish head and pretend it’s tasty so not to offend.
I second this ‘Google will think that the Jothy’s owner is a retard.’
and there are better choices of simile , dear admin.

HB’s blog isn’t a top food blog, why would a single post from him can cause a huge drop in business for Jothy?

@Jothy – if your food is that good, a thousand bad post can’t hurt you, if your food sucks you’ll close shop sooner or later. But now, I googled the restaurant, and the TripAdvisor result at No.3 aside, and this blog at No.1 (because it probably got a shitload of inbound links after the story broke), everything else is about them suing.

One bad review isn’t enough to stop me going to a restaurant, but now I won’t even try because I’m scared of being chased out if I take pictures of my food.

Nice work Jothy’s, you galvanized yourself as a textbook example of the wrong way to respond to a customer’s bad experience sure to be featured in classes like Customer Service 101 and Social Media 101.

  109. It all boils down to personal taste I suppose. I love the fish head curry here and always will be back – I have taken many visitors from overseas, including film makers from around the world and they all raved about the curries! Will definitely be back for more….and more…
    Keep it up, Jothy’s!
